2. Purpose and acceptance

These terms govern access to, browsing of and use of the Site and the features it offers: information about our services, a blog with comments and a contact form. Accessing the Site implies acceptance of the version of these terms in force at that time.

Vicxelcode’s professional services (web development, mobile apps, custom software and consulting) are contracted through a specific quote or agreement with each client. That agreement prevails over these terms in everything it covers: scope, deadlines, pricing, warranties and ownership of the delivered code.

3. Rules of use

You agree to use the Site lawfully, in accordance with these terms, the law, good faith and public order. In particular, the following is prohibited:

• Introducing or spreading viruses, malicious code or any system that may damage the Site, its servers or other users’ devices.
• Attempting to access restricted areas, Vicxelcode’s systems or other users’ data, or circumventing the Site’s security measures.
• Using the contact form or the comments to send advertising, spam, unlawful content or messages unrelated to their purpose.
• Performing bulk or automated extraction of the Site’s content (scraping) without prior written authorisation.
• Impersonating another person or providing false information.

4. Blog comments

Blog articles accept comments. To post one you must provide a name and an email address; the name and the text are published immediately and are visible to any visitor, while the email address is never shown publicly.

You are solely responsible for what you post. Comments that are offensive, defamatory, discriminatory, that infringe third-party rights, that contain other people’s personal data or that are advertising in nature are not allowed. Vicxelcode reserves the right to moderate, edit or delete any comment that breaches these rules without prior notice.

By posting a comment you grant Vicxelcode a free, non-exclusive, worldwide licence to display it on the Site for as long as the article remains published. You may request its removal at any time by writing to hi@vicxelcode.com.

5. Intellectual and industrial property

The Site’s contents (texts, articles, design, logos, images, illustrations, source code and software) are owned by Vicxelcode or by third parties who have authorised their use, and are protected by intellectual and industrial property law.

You may view, print or link to the contents for personal, non-commercial use, citing the source. Any other reproduction, distribution, public communication or transformation requires Vicxelcode’s prior written authorisation.

Third-party trademarks, trade names and logos that appear on the Site belong to their respective owners and are shown for identification purposes only.

6. Links and third-party content

The Site may include links to external websites and third-party content, such as the Google Maps map on the contact page. Vicxelcode does not control those sites and is not responsible for their content, availability or privacy practices; access to them is governed by their own terms.

You may link to the Site freely as long as you do not imply a relationship with Vicxelcode that does not exist or present its content in a misleading way.

7. Disclaimer of warranties and liability

The Site is provided “as is”. Vicxelcode takes reasonable steps to keep the information accurate and up to date and to keep the Site available, but does not guarantee the absence of errors, interruptions or outdated content.

Vicxelcode is not liable for damages arising from the use of the Site, from the inability to access it, from decisions taken on the basis of its information or from the presence of viruses or other harmful elements that may alter your system, except where the law provides otherwise. Nothing in these terms limits the rights you have under consumer law when you act as a consumer.

Vicxelcode may change these terms, as well as the Site’s content and features, at any time. Changes will be published on this page with the date of the last update and will apply from the moment they are published. We recommend checking this page periodically.

10. Applicable law and jurisdiction

These terms are governed by Spanish law. For any dispute arising from access to or use of the Site, the parties submit to the Courts of Lugo (Spain), unless you act as a consumer, in which case the courts of your place of residence will have jurisdiction.
